David Carrington-Jones was convicted of raping and sexually assaulting his two nieces (his brothers daughters). The allegations emerged when one of the girls (KJ) told one of her teachers that Carrington-Jones had sexually assaulted her. As a result, both girls were interviewed by the police at their foster home. They disclosed a history of alleged rape and indecent assault from about 1995 to about 1999. The girls parents were divorced, and KJ admitted to lying when she wanted to move away from either parent by alleging that someone had done something to her, but she denied that she had lied about Carrington-Jones. Her sister (LJs) claims were similar in nature. A medical report from 2000 suggested both girls had had repeated sexual intercourse. On appeal, a CCRC investigation found that KJ had a proved tendency to make false allegations that she was a victim of sexual crime. She had made accusations against multiple people, including her stepfather.Her stepfather was able to provide an unshakeable alibi for the two occasions when he was supposed to have raped KJ and following an investigation admitted that she had fabricated the allegations against her stepfather because she did not like him. As a result she received a caution for wasting police time. The court found that this new material would severely undermine any confidence that any jury could have had in KJ’s evidence and as a result the conviction was quashed. In relation to LJs evidence, the court noted that LJ admitted that above all else she wanted to stay with KJ, and that she had only given evidence after she was aware of KJ’s allegations. As a result, convictions in relation to LJ were also quashed.
