Mr Balasubramaniam was convicted following a victim being attached and beaten to death by a group of men near to his home in London. Mr Balasubramaniam was initially charged with murder. One of his co-defendants offered to plead guilty to a lesser offence and give evidence for the prosecution. This co-defendant became the principal prosecution witness and gave evidence against Mr Balasubramaniam, who was acquitted of murder but convicted of conspiracy to commit assault occasioning actual bodily harm. His conviction was overturned when new evidence came to light, showing a “deal” between the prosecution and their principal witness, which called into question the witnesses reliability.
