Shaun Hegarty was convicted of aggravated burglary. The conviction was based on identification evidence. The appeal was quashed on the basis of concerns over the reliability of the identification evidence. Although the injured party picked Hegarty out of a line up, the other two witnesses failed to do so. A victim impact report also showed that the victim may have obtained photos of the defendant and this was a possible contamination of the identification process. Hegarty’s burglary conviction was quashed, but he remained in prison serving a separate 18 year jail term for murder.
