Shah Nawaz and his co-defendant Mohammed Rafiq were convicted of conspiracy to import 2kg of heroin from Pakistan. They appealed on the grounds of non-disclosure of crucial evidence about key informants. The case involved a controlled delivery where a participating informant engaged with Nawaz. The Crown later conceded that material regarding informants which could have been useful for the defence was not disclosed at trial. Both parties agreed that the appeal should be allowed. Nawaz’s conviction was quashed by the Court of Appeal in January 2007. Once Shah Nawaz’s conviction was overturned, the conviction of Mohammed Rafiq was found to be unsafe as a result. Rafiq’s conviction was quashed by the Court of Appeal in July 2008.
