Roy Burnett was convicted of rape. The claimant reported that he followed her home from a bus, dragging her into woodland and threatening her with a knife before raping her. A doctor examining her the next day found scratches on her body but no injuries to the mouth or vagina and no evidence of semen. Burnett was identified at an ID parade. On. appeal, fresh expert evidence indicated her injuries were typical of self-inflicted injury. It was also revealed that after the trial the claimant had made another rape claim against other men which was found to be inconsistent and false. As a result it was found the claimant’s evidence was likely to be false and the conviction was unsafe. The court noted that the crime “almost certainly never happened at all.”
