Patrick Livingstone
Patrick Livingstone was convicted of the murder of Samuel Llewellyn. The only evidence against him at trial was from three Royal Ulster Constabulary officers who claimed that he confessed to the murder. On appeal, evidence of police brutality was presented. One man said he was beaten into signing a statement claiming that Livingstone admitted the shooting to him, but this was not disclosed to the defence. It was found that claims of police mistreatment were never tested and would have opened a line of enquiry that might have affected the credibility of the police witnesses. The court noted a significant sense of unease about the correctness of the verdict, and allowed the appeal.
