Joseph Kassar was convicted of two counts of being knowingly concerned in the fraudulent evasion of the prohibition on the importation of a controlled drug, namely cocaine. On appeal disclosure failures came to light relating to information and material held by Customs and Excise which were relevant to the role that Kassar played in the importations. The court concluded that there was such a failure in disclosure that was so central to the prosecution’s case that the appeal must be allowed and the conviction quashed.
