David Luxford was convicted of rape and indecent assault. A friend of the family made an allegation that, 13 years earlier, he had assaulted and raped her over a period of two years while visiting her parents home. The prosecution’s case was based entirely on the complainant’s testimony. He was found guilty at an initial trial and at a retrial. At a second appeal inconsistencies in the alleged victims account were uncovered (for example, she claimed to be a virgin before the alleged abuse, but an ex-boyfriend gave testimony that they were having a sexual relationship before that time), and the conviction was quashed.
