Brian Shivers
Brian Shivers and Colin Duffy were convicted of double murder and attempted murder following an IRA attack outside an army barracks. Duffy was later acquitted. It was alleged that Shiver’s DNA was found on matches and a mobile phone inside a partially burned car used during the attacks. His conviction was overturned, and he was found not guilty by a judge at a retrial. The judge noted that the attack was carried out by a determined gang and that Shivers (who was of previously good character, had cystic fibrosis and was engaged to a protestant woman) was an unlikely associate for them to rely on. The judge found that the evidence was circumstantial and that the DNA found may have been placed there by “an innocent transfer.” The judge said that he was not satisfied beyond a reasonable doubt that Shivers was guilty and as a result he was cleared of all charges.
