Anthony Clibery was convicted of the rape of his wife, who claimed he had raped her twice during a meeting to discuss the sale of their matrimonial home on 1 June. Clibery claimed that sexual activities short of intercourse had taken place on 13/14 May and that they had parted on good terms. He claimed he was at work at the time of the alleged attack. On appeal, new evidence cast doubt on Mrs Clibery’s credibility. Specifically, evidence showed she had a propensity for telling lies. For example, it became clear she had lied to the District Judge in evidence and that she had lied to the Benefits agency. The court concluded that the evidence was capable of casting doubt on the truthfulness of the complainant and that they could not with confidence conclude that the jury would have reached the same verdicts had they known of the evidence. On that basis the convictions were quashed.
