Mr Akanbi-Akinlade was searched at Heathrow Airport after arriving on a flight from Nigeria. The handles of his suitcase were found to contain cocaine, however he always denied knowing that he was transporting drugs. He claimed to have been given the suitcase by a man he knew only as “Michael” or “Segun,” who was the boyfriend of his friend, Bunmi Cole. When interviewed under caution Ms Cole denied she had a boyfriend and said she didn’t know anyone by the name of Michael or Segun. Her evidence was the only evidence to rebut Mr Akanbi-Akinlade’s defence that he knew nothing of the drugs.

On appeal, a marriage certificate was siezed showing that Ms Cole was married to a person named Michael, who she had a child with. The conviction was quashed on the basis that his defence was not properly evaluated given the perjured evidence.
