A was convicted of indecent assault on the basis of witness evidence and medical evidence showing internal signs of abuse to a child complainant. The conviction was quashed when new evidence, given by a friend of the complainant, provided an alternative explanation for the internal signs of abuse. The Crown conceded that this new evidence was capable of belief. Due to the delays involved in the case, a retrial was not considered in the interests of justice.
